10 years sentence upheld for GI rapist

Lawyer pleas to the contrary, Seoul High Court upheld the 10 year sentence on the Kevin Lee Flippin creature.

Hopefully, he’ll soon have a long-term buddy in Cheonan, too.

Also on the USFK crime front, the douche (at the very least) in Mapo has actually chosen to undergo a jury trial. If the victim opposed this, however (and she might, given the nature of the alleged offense), it will revert to an ordinary trial.

In the decision, the court sought to rationalize its decision not to lower the sentence on account of the defendant’s intoxicatio because there (allegedly) was no evidence of his mental incapacitation as a result thereof. Interestingly, in the cases of which i am aware in which Korean defendants have had their punishments reduced on such grounds, there also was no such proof. Draw your own conclusions.

Should I be angry because of all the times being drunk worked as a defense, or should I be angry because this time it didn’t, which is totally unfair because of the fact it worked all the other times?

Anyway, I am happy that this guy is going to be locked up for a long time.

This kind of story saddens me deeply – especially for the young woman who was sexually assaulted.

What made me shake my head, in addition to this cowardly assult act, was his desire to take $4.50 after the assult!

Again, a sad, poor decision by this military GI.

Unrelated, but apparently the Megaupload hacker has been captured in NZ, and it sounds like something straight out of a B-grade hollywood comedy.

When police arrived, Mr Schmitz entered the house and activated electronic locks, Detective Inspector Grant Wormald said. Police neutralised the locks and then had to cut their way into a safe room, where Mr Schmitz was found with what looked like a sawn-off shotgun, Inspector Wormald said.

”It was definitely not as simple as knocking at the front door.”

By the looks of the photo, the safe room must have been well-stocked with lamingtons.

Ya just GOTTA love the random “justice” of the South Korean legal system. If the GI was a high executive in say Samsung, no doubt the sentence would have been probation.

Your comparison is irrelevant. This is about a judicial system that reduces sentences based on politics or economics. The GI happened to be from a group that is somewhat resented in Korean society (there’s the politics), and he certainly wasn’t a major corporate executive (there’s the economics), so he was lucky to get 10 years in a country that will generally only sentence a rapist to 3-5.

Setnaffa got it right. If he was Korean, and claimed he was drunk, and said he was really really sorry, he woulda got 3 years maybe. Oh, and if you change the victim to say, a juicy girl, or some other “undesireable”, instead of an innocent college student, he likely woulda got even less, because in this country, it’s not about the crime committed. it’s about who the victim is, who the accused is, and how much money is involved. With all those random factors involved, it’s anyone’s guess.
