Family Who Raped Mentally Disabled Relative Given Jail Time

by Robert Koehler on March 20, 2009

You’ll be happy to learn that the four family members who were given suspended sentences for repeatedly raping their mentally disabled teenage relative have been re-sentenced to prison time. All except the grandfather (who apparently argued that he couldn’t have raped her since he was impotent), whose original four-year suspended sentence was upheld due to health problems.

3 years & 1.5 years seem like a disingenuous execution of justice given that they raped their own mentally disabled niece. And the whole “I’m impotent” defense is horseshit – ever heard of the words accessory and accomplice?

Big “what the fuck” moment. Yet again.

“And the whole “I’m impotent” defense is horseshit – ever heard of the words accessory and accomplice?”

Or Viagra?

What he meant was “I discontinued raping her after I became impotent–after that I just watched”

The better sexual assault laws are expansive enough to cover penetration by a sexy part into a sexy or non-sexy part, or a non-sexy part into a sexy part.

Something tells me he could have assaulted this poor girl with the flat end of a fire extinguisher and still gotten off since he was “impotent.” Shameful.

I think they deserve it, but I’m concerned about the re-sentencing. I guess that’s different from re-trying, but how easy is it to re-sentence someone? Could they do it a year later? five years later?

Oh, I know they deserve worse: don’t get hung up on the “I think…” part of the above post.
