Frivolity Rears its Ugly Head Yet Again

by WangKon936 on September 17, 2008

… in the form of Roy Pearson.  Yes, that horse just ain’t dead.  The guy just keeps finding a way to get in the news and embarrass himself.

According to the WaPo, Roy had convinced an appellate panel to review the infamous case where he tried to sue two Korean American dry cleaner owners $54 million for a pair of lost pants.  It’s amazing this guy still has enough credibility to convince anyone of anything!  Yet, here we stand.

Oh, by the way, he’s also suing the DC government for “breaking the law” when it didn’t renew his contract as an administrative law judge.

He sounds like a hagwon owner I once dealt with. Too bad he’s not in Seoul (and Korean), he’d fit right in.

2 dogbertt September 17, 2008 at 4:37 am

You should of spelt it “frivolity”, amigo.

Then again, that “judge” probably can’t spell it right himself.

3 WangKon936 September 17, 2008 at 4:49 am

…fixed…

4 thekorean September 17, 2008 at 5:05 am

@2,

that “should of” is high comedy. (Not about you dogbert, but about WK.)

5 thekorean September 17, 2008 at 5:18 am

Oh, by the way, he’s also suing the DC government for “breaking the law” when it didn’t renew his contract as an administrative law judge.

I just took a look at the complaint – it was 52 pages of unintentional comedy goldmine. Basically this guy thinks he was fired because — get this — he was a whistle blower! He expressed concern that ALJ was not truly independent, and that was the reason his contract wasn’t renewed. Ohhh, I see. So causing a national embarrassment of the judiciary by carrying on with this bullshit lawsuit had nothing to do with you no longer being a judge, albeit a crappy one that deals with parking tickets.

If anyone wants to read, it’s 08-cv-758 at D.D.C.

6 dogbertt September 17, 2008 at 5:39 am

You took a bullet for us reading that, friend.

For some reason, that “judge” reminds me of The Metropolemician.

7 WangKon936 September 17, 2008 at 5:48 am

I really have to stop relying on google as a spell checker…

8 Darth Babaganoosh September 17, 2008 at 7:57 am

The case was gone over in detail several times in The True Stella Awards mailing list. TTSA is for exposing judiciary and legal abuses, so this one got a lot of presstime.

I guess more fodder for the “comedy gold” cannon.

9 roboseyo September 17, 2008 at 8:12 am

Just wait. If he doesn’t get his 54 million dollars, he’s going to take a can of paint thinner and try to burn the Lincoln Memorial, like wasisname at sungnyemun over here. He’s basically done about as much damage to the credibility of American Legal Process as that clown did to Sungnyemun.

I’d love to read a few pages of his diary, or be a fly on the wall at his family dinner table.

“Jane, can you pass me the potatoes?”
“Sure, Dad.”
“Jesus, Jane! You spilled a potato crumb on the table! I have to replace this thing! I expect you to pay for the table, a new living room set, and you’re not my daughter anymore, bitch!”
“Come on, Dad. It’s just a tiny spill. See, look. I cleaned it up.”
“Oh God! I’m so mentally distressed! I need to lie down.”
“Sorry, Dad.”
“Don’t you talk to me! Your mother never loved you anyway, you sloppy potato-fiend!”

I have a hunch about the psychology of Pearsons.

Anyone want to wager that this dude speaks and sounds like Bryant Gumbel? Yeah, y’all, he’s that kind of brother. ;)

11 a-letheia September 17, 2008 at 8:28 am

Whoever said this was about a pair of pants?

I admire his sticktoitiveness. Hopefully businesses will think twice before making false promises and handing customers a line of bullsh*t on a regular basis, which is exactly what these cleaners did to this man. And they thought he would just go away.

I for one believe the level of service at the retail and other levels in the US has hit bottom. These cleaners played chicken with the wrong customer.

12 thekorean September 17, 2008 at 8:32 am

@11

I admire his sticktoitiveness.

Reminds me of a bit from Laura Kitelinger: “I recently read a news about this teenage girl who pulled all of her hair out, one by one. I thought — Good! American teenagers know how to finish what they started!”

13 a-letheia September 17, 2008 at 8:52 am

#12. I guess all law cases look a little funny from a pedestrian point of view like yours.

Bottom line: you only care because these cleaners share your race. That is something I find kind of sad in a way.

14 NES (BANNED SOCKPUPPET TROLL!!!) September 17, 2008 at 9:00 am

…and you only care because the retard judge shares your psychosis. That is something I find hilariously funny in a way.

15 thekorean September 17, 2008 at 9:42 am

@13,

You got the joke about you! Kudos for that. Certain sockpuppets would not have gotten that.

If by “pedestrian”, you mean three years of law school and two years of practice, sure, my point of view is pretty pedestrian.

Here is my bottom line, tell me how it tastes: I only care because it makes a mockery of our legal system. While I have an infinite store of lawyer jokes, in my serious moments I care deeply about the authority of the law.

The false promises cited by Pearson? “Same Day Service” and “Satisfaction Guaranteed” signs hung on the cleaner’s window! Based on that, Pearson demanded $67 million. It took the Chungs $83K to make this go away. They deserve that for a missing pair of pants? For fuck’s sake.

tort reform

17 WangKon936 September 17, 2008 at 9:55 am

# 13,

As I recall, plenty of vanilla bean Americans also thought Pearson was a nut job.

18 roboseyo September 17, 2008 at 9:57 am

now, all we need is for a-lethia to post 66 999 998 more comments razzing The Korean, and we’ll have an equivalent case.

19 alec931 September 17, 2008 at 10:10 am

@11 (a-lethia):

I agree. Roy Pearson is right. How dare these stupid Koreans mess with this guy? What’s worse is that these criminal Koreans couldn’t even find his missing pants and didn’t even offer a settlement for all the mental anguish this man suffered for his tragic loss. $54 million? Roy went too easy on them. He should have sued for at least $200 million!

20 WangKon936 September 17, 2008 at 10:17 am

I don’t mind ripping a new one with large monolithic companies where they could actually afford $54M and it’s enough of a slap in the wrist to have the big company reform their ways, but what sense is there in suing a small mom and pop store for that much amount of money? What message can you possibility convey other than you are a greedy mofo?…

It’s just important to view Pearson for what he is… not a consumer crusader if you are that gullible, but a greedy opportunist.

21 WangKon936 September 17, 2008 at 10:21 am

Just out of curiosity… I wonder how many so called individual commenters here are actually sockpuppets?

My guess is that any time we have a randomly named commenter who has an unrecognizable screen name, but has a recognizable writing style or at least familiarity with the type of language used at MH is likely someone’s sockpuppet…

22 alec931 September 17, 2008 at 10:22 am

Wangkon: “Oh, by the way, he’s also suing the DC government for “breaking the law” when it didn’t renew his contract as an administrative law judge.”

I don’t understand your sarcasm. Roy Pearson’s contract was not renewed supposedly due to him getting negative attention from the Korean media, when clearly it was because his superiors in the government were bitter that Pearson exposed rampant corruption. It’s only logical that he sue for his rights.

23 NES (BANNED SOCKPUPPET TROLL!!!) September 17, 2008 at 10:32 am

The Korean: You got the joke about you! Kudos for that.

But isn’t that negated by him not getting that you’re a lawyer after you cited the case file number and that he thinks watching Law and Order and failing out of paralegal school qualify him as having more than a pedestrian point of view?

P.S. Be nice to sockpuppets. Sockpuppets are [fake] people too.

24 NES (BANNED SOCKPUPPET TROLL!!!) September 17, 2008 at 10:37 am

WangKon: Just out of curiosity… I wonder how many so called individual commenters here are actually sockpuppets?

I am! I am!

25 alec931 September 17, 2008 at 10:43 am

NES shut up. I’m sick of sockpuppeting trolls like you.

Yours truly,

26 alec931 September 17, 2008 at 10:45 am

Whoops. That last line was a typo :(

27 cm September 17, 2008 at 11:08 am

“which is exactly what these cleaners did to this man. And they thought he would just go away. ”

Who are these “cleaners” that you speak of? There was just one “cleaner” that was involved in this case – the Chung family. But you really meant those evil “Koreans”. It was the Chung family who dared to offer the judge only $10,000 for his pants and for his loss. It’s the Chung’s who should be hung upside down the pole.

“Bottom line: you only care because these cleaners share your race. That is something I find kind of sad in a way.”

No. Nobody brought up race, until you did.

And nobody said this, but I’m going to say it anyway. (Politeness off) Yer an idiot. (Politeness on).

28 Darth Babaganoosh September 17, 2008 at 11:09 am

Alec, he was not renewed because a JUDGE should know better than to make a mockery of the legal process with such a frivoulous lawsuit. “frivoulous” in the legal sense.

Would YOU trust such a person to judge fairly were you to be in his court? I wouldn’t. His judgement is now suspect because of such nonsense.

29 thekorean September 17, 2008 at 11:17 am

@23,

But isn’t that negated by him not getting that you’re a lawyer after you cited the case file number …?

Well, you know, it takes baby steps. I believe in positive reinforcement. Eventually s/he will catch on.

Be nice to sockpuppets. Sockpuppets are [fake] people too.

I like socks. They keep my feet warm and gets me through lonely nights

30 alec931 September 17, 2008 at 11:22 am

@28 (Darth Babaganoosh):

My bad, Darth. I was being sarcastic. Perhaps I should have made it more obvious. I think Roy Pearson is an ass. I was just being sarcastic to mock the idiots who are actually supporting his actions (e.g. a-letheia)

;)

31 WangKon936 September 17, 2008 at 1:14 pm

Okay fellas, I have a bombshell secret…

Pawikirogi was my trolling sockpuppet…!

Muwahahaha!!!!

32 NES (BANNED SOCKPUPPET TROLL!!!) September 17, 2008 at 1:20 pm

I seriously considered that Pawi might be Robert’s sockpuppet.

33 cmm September 17, 2008 at 2:30 pm

But whose sockpuppet is Baduk? If there is anyone not for real, it’s gotta be him.

I’ve contemplated that wjk is a sockpuppet too, and whoever he really is intentionally comes across as a little spastic and hides his/her natural writing style by using the series of one line “paragraphs.”

34 a-letheia September 17, 2008 at 2:31 pm

cm: Who are these “cleaners” that you speak of? There was just one “cleaner” that was involved in this case – the Chung family. But you really meant those evil “Koreans”.

Calm down. In ENGLISH we say, “Take the suit to the cleaners”, meaning one cleaner’s shop and all the “cleaners” inside of the one shop. Pawi is the only evil Korean I know.

Would you care if these CLEANERS weren’t Korean? It is a good question to ask yourselves. Because justice for the Kyopo element here, it seems, means what is good for your tribe.

Justice for me is an abstract issue. I personally think this guy has a point. What does “Satisfaction guaranteed” mean? Does that mean losing pants over and over again, and giving him the run-around, and making him miss important meetings?

Do I feel bad for the Chungs? Maybe (You don’t know). But I don’t JUST see this case in a single perspective (the way the Kyopos do). If you will kindly review my first post above, you will see that this was my only point.

If you advertise it, you better deliver…

35 NES (BANNED SOCKPUPPET TROLL!!!) September 17, 2008 at 3:08 pm

You are right that they should be held liable, but not for $54 million. The cost of a new pair of the same kind of pants and any other costs incurred as part of their negligence should have covered it. Instead, Pearson made an ass out of himself and tried to make an even bigger traveshamockery out of the system than it already is. Maybe he could have won if he had spilled hot coffee, or hot mashed potatoes, on himself while inside the dry cleaners due to the sudden shock of learning that his pants were missing. Sloppy potato-fiend!

Tort reform.

Baduk 2008!

36 bumfromkorea September 17, 2008 at 4:50 pm

Maybe everyone here is a sock puppet except me. Could it be that this whole time, it was just Robert talking and arguing with himself on this website while I accidentally stumbled into his den of madness? … What if… what if I am also a sock puppet? What if I’m one of Robert’s sock puppet that accidentally gained self-awareness? Does that mean that I am me, or I am someone else?

Stepping out of the whole doubting-own-existence thing…

Would you care if these CLEANERS weren’t Korean?

I have a feeling that if they weren’t Koreans, it wouldn’t even have made it on this blog. You know, the blog being about Korea and all. But maybe my thoughts are all fuzzy by that pseudo-Descartes crap I wrote up there. :-D

What does “Satisfaction guaranteed” mean? Does that mean losing pants over and over again, and giving him the run-around, and making him miss important meetings?

Which warrants him getting $54 million? Didn’t the Chungs already try to settle him down by offering to pay him the cost of his pants? See, the whole ‘ridiculous’ factor comes in when the lawsuit becomes a tabloid farce with that 54 million number.

37 NES (BANNED SOCKPUPPET TROLL!!!) September 17, 2008 at 5:05 pm

I’m a monkey banging out random messages on a keyboard. Robert still owes me a banana.
